What gap in the original IT Act 2000 did the 2008 amendment address?+
The 2000 Act had limited provisions for offences like identity theft, cyber stalking, and publishing sexually explicit material, and gave intermediaries little clarity on liability. The 2008 amendment added targeted sections to cover these gaps and expanded government powers around interception and monitoring.
Is Section 66A still enforceable today?+
No. Section 66A, which criminalised sending offensive messages through communication services, was struck down by the Supreme Court of India in Shreya Singhal v. Union of India (2015) for being unconstitutionally vague and overbroad, though it remains relevant when reviewing older case files that cited it.
