Hedonistic Calculus

Common questions

How does hedonistic calculus justify proportionate punishment?+

If a penalty is too light, the gain from offending still outweighs the pain of punishment in a rational actor's calculation, so classical theory holds punishment must be severe, certain, and swift enough to tip that balance against offending.

What is the main criticism of hedonistic calculus as a basis for sentencing policy?+

It assumes offenders act as rational calculators weighing costs and benefits before committing crime, an assumption later criminology challenged by pointing to impulsivity, mental illness, and situational factors that undermine rational decision-making.
